Abstract

The contracting out of the work force is an increasing activity in our country, while in the national legal order it has broad legislation as required to regulate this type of work, conflicting standards to exist only in as to the determination of the responsibilities of the main contratita, in a way that is a worker who lends service, who is placed in a position of disadvantage and vulnerability, so it gets exposed the need for regulation. This paper presents a general analysis based on doctrinal criteria, on the application of this figure, the valuation of the jurisprudential criteria sitting at home, to finally propose the form that should be regulated to ensure an effective protection of rights.
